SUBSTITUTE TRUSTEE’S FORECLOSURE SALE OF REAL PROPERTY

UNDER AND BY VIRTUE of the power and authority contained in that certain Deed of Trust executed and delivered by Michael T. Benson and Cynthia A. Howard, dated October 15, 2008 and recorded on October 15, 2008 in Book No. DOC 475 at Page 447 in the Office of the Register of Deeds of Transylvania County, North Carolina; and because of default in the payment of the indebtedness secured thereby and failure to carry out and perform the stipulations and agreements contained therein and, pursuant to demand of the holder of the indebtedness secured by said Deed of Trust, the undersigned Substitute Trustee will place for sale, at public auction, to the highest bidder for cash at the usual place of sale at Transylvania County Courthouse, Brevard, North Carolina on October 1, 2015 at 10:00 AM that parcel of land, including improvements thereon, situated, lying and being in the City of Rosman, County of Transylvania, State of North Carolina, and being more particularly described in the above referenced Deed of Trust.

The terms of the sale are that the real property hereinbefore described will be sold for cash to the highest bidder. A deposit of five percent (5%) of the amount of the bid or Seven Hundred Fifty Dollars ($750.00), whichever is greater, is required and must be tendered in the form of certified funds at the time of the sale. The successful bidder shall be required to pay revenue stamps on the Trustee’s Deed, any Land Transfer Tax and costs of recording the Trustee’s Deed.

The real property hereinabove described is being offered for sale “AS IS, WHERE IS” and will be sold subject to all superior liens, unpaid taxes, and special assessments. Other conditions will be announced at the sale. The sale will be held open for ten (10) days for upset bids as by law required.

If for any reason the Trustee is unable to convey title to this property or the sale is set aside, the sole remedy of the purchaser is the return of the deposit. Furthermore, if the validity of the sale is challenged by any party, the Trustee, in its sole discretion, if it believes the challenge to have merit, may declare the sale to be void and return the deposit. In either event the purchaser will have no further recourse against the Mortgagor, the Mortgagee, the Mortgagee’s attorney or the Trustee.

Additional Notice Where the Real Property is Residential With Less Than 15 Rental Units:

An order for possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon 10 days’ written notice to the landlord. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.

ELECTION FOR THE City of Brevard, North CAROLINA

Notice is hereby given pursuant to GS 163-33(8) that a Municipal Election will be held on Tuesday, November 3, 2015 in the City of Brevard, North Carolina for Mayor and Members of City Council. Polls will be open from 6:30 AM to 7:30 PM. The polling places for each precinct will be located at:

Brevard #1: Community Services Building Conference Room, 98 E. Morgan St., Brevard;

Brevard #2: VFW Building, 50 Veterans Cir., off Nicholson Creek Rd., Brevard;

Brevard #3: Transylvania County Rescue Squad-Brevard Unit, 233 Fisher Rd., Brevard;

Brevard #4 – Brevard-Davidson River Presbyterian Church Fellowship Hall, 249 E. Main St., Brevard;

Pisgah ForestTransylvania County Public Safety Facility, 153 Public Safety Way, Brevard.

Absentee ballots are allowed. Requests for an absentee ballot must be made in writing and received in the Transylvania County Board of Elections office by 5:00 PM on Tuesday, October 27, 2015. Absentee voting begins on Friday, October 2, 2015 and ends at 5:00 PM, Monday, November 2, 2015. The Board of Elections will meet October 13, 20, 27, and November 2 at 5:00 PM, October 31 and November 3 at 2:00 PM, and other times as may be necessary for the purpose of approving absentee ballot applications. A meeting to review supplemental executed absentee ballots will be held on November 6, 2015 at 5:00 PM.

One-stop absentee voting will be held in the Transylvania County Board of Elections Office, 221 S. Gaston St., Brevard, beginning Thursday, October 22, 2105 and ending Saturday, October 31, 2015. One-stop voting hours are Monday through Friday, 8:30 AM to 5:00 PM and Saturday, October 31, 2015 from 8:30 AM until 1:00 PM.

The Canvass meeting will be held at 11:00 AM in the Transylvania County Board of Elections Office, 221 S. Gaston St., Brevard, on Tuesday, November 10, 2015.

All residents of the City of Brevard who have resided within the corporate limits of the City of Brevard for at least 30 days prior to Election Day and are registered to vote with the Transylvania County Board of Elections may vote in this election. Voters who are previously registered need not re-register for this election. Those residents of the City of Brevard who are not registered must register on or before Friday, October 9, 2015 in order to be eligible to vote in this election. Any voter who has moved outside his or her precinct but within the county or changed their name since the last election should notify the Board of Elections in writing by Friday, October 9, 2015.
