Wife Won't Be Charged In Shooting Case - Brevard NC


A Lake Toxaway woman who fatally shot her husband will not be charged.

District Attorney Greg Newman said this morning that Tina Bayne shot and killed her husband Thomas Bayne on Sept. 25 in self-defense after a tumultuous night.

“We decided we just don’t have the evidence to charge her with a crime,” Newman said.

According to Newman, Thomas Bayne, a former Brevard police officer, pointed a gun at Tina Bayne’s head twice during the evening, even pulling the trigger both times, with no ammunition in the gun.

Tina Bayne had tried to escape the home twice during the evening in which the Baynes’ daughter said, during a 911 call, that the couple had been fighting.

Newman said Thomas Bayne would not let his wife attend her step-father’s funeral the previous day. Newman said Thomas Bayne had been shot four times by his wife before dying that evening. Tina Bayne ran to a neighbor’s house to call 911 after the incident. Tina Bayne had been “very cooperative” with investigators, Newman said.

“North Carolina does allow for people to defend themselves,” he added.
