NOTICE OF DISCHARGE OF UNTREATED SEWAGE

The City of Brevard experienced a discharge of untreated sewage from the sewer lift station located at 273 Gallimore Road, and occurred as a result of rain attributed inflow in the Brevard area. This discharge event began on Monday, October 23, 2017 at 12:00 PM and lasted for approximately 6.5 hours. Collections System and Maintenance Division personnel remained on duty and monitored pump speed and pressures during the event. The pump and haul team, with assistance from Mike’s Septic Service, were able to capture sixteen loads of sewer totaling 48,000 gallons from the discharge manhole; and this amount was disposed of at the Waste Treatment Facility on Wilson Road. The total estimated amount of discharge reaching the surface waters of Singing Branch in the Jumping Branch Basin was 59,796 gallons.

Citizens are reminded that any discharge of storm water, surface water, ground water, roof runoff, and subsurface drainage connected to the city sewer system is a violation of the City Code of Ordinances. Customers uncertain of the soundness of their connection to the sewer system may call the City of Brevard Public Works Department at (828) 884-2171 Option 4 to confirm if they have a broken cleanout or improperly attached roof drain or sump pump. This notice was required by North Carolina General Statutes Article 21 Chapter 143.215.C.

NOTICE OF PUBLIC HEARING

RESOLUTION NO. 2017-21

A RESOLUTION DECLARING THE INTENT OF THE Brevard City Council TO CONSIDER THE CLOSING OF AN UNOPENED PORTION OF McMINN AVENUE

WHEREAS, North Carolina General Statute 160A-299 authorizes the City Council to permanently close public streets and alleys; and

WHEREAS, the City has received a request to close an unopened portion of McMinn Avenue, located at the corner of McMinn Avenue and Verdery Avenue. The unopened street right-of-way is thirty-six feet (36’) in width, and is approximately two hundred and thirty six feet (236’ +/-) in length. The street right-of-way runs between properties owned by Erica Damman, Royce Chestnut, Zachary R. Noble and Kathryn Grace MacEachern; and

WHEREAS, the City Council considers it advisable to conduct a public hearing for the purpose of giving consideration to permanently closing the aforementioned street right-of-way.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE City of Brevard, North CAROLINA:

Section 1. That a Public Hearing will be held at 7:00 p.m., or as soon thereafter as possible, on Monday, November 20, 2017, in Council Chambers located at 95 West Main Street, Brevard, North Carolina, to consider an order to permanently close said street right-of-way.

Section 2. The City Clerk is hereby directed to publish this Resolution of Intent once a week for four (4) successive weeks prior to the Public Hearing in the Transylvania Times.

Section 3. The City Clerk is further directed to transmit by Certified Mail, Return Receipt Requested, to each owner of property abutting on said street right-of-way, a copy of this Resolution of Intent, and shall cause a notice of the Public hearing to be prominently posted in at least two places along the street.

Section 4. This Resol-ution of Intent shall become effective upon its adoption and approval.

Notice of Public Meeting

A public meeting of The Board of Brevard Academy: A Challenge Foundation Academy, Inc. is scheduled on Wednesday, November 8, 2017 at 5PM. The meeting location is at the gym on the school grounds. It is the desire of the Board of Directors to secure a loan from the United States Department of Agriculture, Rural Development to obtain sufficient funds to purchase Brevard Academy facility from the Challenge Foundation Properties. Assets acquired by the organization may be encumbered to secure any loan obtained. The public is invited to attend the meeting and comment on the proposed action.
