The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” Neither the Trustee nor the holder of the note secured by the deed of trust, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either Trustee or the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments including but not limited to any transfer tax associated with the foreclosure. Also, if your lease began or was renewed on or after October 1, 2007, be advised that you may terminate the rental agreement upon written notice to the landlord, to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time notice of termination is provided. You may be liable for rent due under the agreement prorated to the effective date of the termination.

Notice of Public Meeting

A public meeting of The Board of Brevard Acad-emy: A Challenge Found-ation Academy, Inc. is scheduled on Wednesday, November 8, 2017 at 5PM. The meeting location is at the gym on the school grounds. It is the desire of the Board of Directors to secure a loan from the United States Department of Agriculture, Rural Development to obtain sufficient funds to purchase Brevard Academy facility from the Challenge Foundation Properties. Assets acquired by the organization may be encumbered to secure any loan obtained. The public is invited to attend the meeting and comment on the proposed action.

NOTICE OF DISCHARGE OF UNTREATED SEWAGE

The City of Brevard experienced a discharge of untreated sewage from the sewer lift station located at 273 Gallimore Road, and occurred as a result of rain attributed inflow in the Brevard area. This discharge event began on Saturday, October 28, 2017 at 07:15 PM and lasted for approximately 5.58 hours. Collections System and Maintenance Division personnel remained on duty and monitored pump speed and pressures during the event. The pump and haul team, with assistance from Mike’s Septic Service, were able to capture fourteen (14) loads of sewer totaling 40,500 gallons from the discharge manhole; and this amount was disposed of at the Waste Treatment Facility on Wilson Road. The total estimated amount of discharge reaching the surface waters of Singing Branch in the Jumping Branch Basin was 52,094 gallons.

Citizens are reminded that any discharge of storm water, surface water, ground water, roof runoff, and subsurface drainage connected to the city sewer system is a violation of the City Code of Ordinances. Customers uncertain of the soundness of their connection to the sewer system may call the City of Brevard Public Works Department at (828) 884-2171 Option 4 to confirm if they have a broken cleanout or improperly attached roof drain or sump pump. This notice was required by North Carolina General Statutes Article 21 Chapter 143.215.C.

Program Closeout

City of Brevard will conduct a Public Hearing at 7:00 p.m. or as soon thereafter on Monday, November 20, 2017 at 7:00 pm at the City of Brevard Council Chambers, 95 W. Main Street, Brevard NC 28712. The City of Brevard is the recipient of a NC Department of Commerce, Main Street Downtown Redevelopment Community Development Block Grant (CDBG) Number 15-E-2766 for the Moose Tracks & DD Bullwinkels Outdoor Project at 60 East Main Street, Brevard. The purpose of the public hearing is to close-out the activities undertaken with the City’s CDBG #15-E-2766 Downtown Redevelopment Funds.

Written comments addressed to Daniel Cobb, Planning Director, City of Brevard, 95 W. Main Street, Brevard, NC 28712, will be accepted prior to the hearings.

All facilities are handicapped accessible. All interested persons are invited to attend this hearing.
