Opinion Places County Zoning Plan In Doubt
Transylvania County's move to try and limit expansion of Brevard's zoning authority into unincorporated areas of the county just outside city limits appears to have hit a wall.
A legal opinion issued to county officials March 12 by Curtis Potter, an associate with the Brevard firm of Neumann and Hall, says recent court rulings appear to make it impossible for the county to adopt zoning of its own strictly to stop the city's actions.
"Right now, I don't see any reason for the [county] Planning Board to go forward with this," said County Commissioner David Guice.
