SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE

Under and by virtue of the power and authority contained in that certain Deed of Trust executed and delivered by Timothy P. Dugan, recorded in Book Doc 402, Page 225 and Re-recorded in Book Doc 633, Page 551, Transylvania County Registry and because of default in the payment of the indebtedness thereby secured and failure to carry out or perform the stipulations and agreements therein contained and pursuant to the demand of the owner and holder of the indebtedness secured by said Deed of Trust, and pursuant to the Order of the Clerk of Superior Court of Transylvania County, North Carolina, entered in this foreclosure proceeding, the undersigned, Juliana Ferguson, Substitute Trustee, will expose for sale at public auction on the 23rd day of December, 2013, at 12:00 o’clock P.M., at the door of the Transylvania County Courthouse, Brevard, North Carolina, the following described real property (including the house and any other improvements thereon):

Third party purchasers must pay the excise tax, pursuant to N.C.G.S. Sec. 105-228.30, in the amount of One Dollar ($1.00) per each Five Hundred Dollars ($500.00) or fractional part thereof of the final sale price, and the Clerk of Court’s fee pursuant to N.C.G.S. Sec. 7A-308, in the amount of Forty-five Cents ($0.45) per each One Hundred Dollars ($100.00) or fractional part thereof of the final sale price or Five Hundred Dollars ($500.00), whichever is less. Pursuant to N.C.G.S. Sec. 45 21.10(b), and the terms of the Deed of Trust, any successful bidder may be required to deposit with the Substitute Trustee immediately upon conclusion of the sale a cash deposit of the greater of five (5) percent of the amount bid, or Seven Hundred Fifty and No/100 Dollars ($750.00). NOTICE TO OCCUPANTS OF RESIDENTIAL REAL PROPERTY WITH LESS THAN 15 RENTAL UNITS:

An order for possession of the property may be issued pursuant to N.C.G.S. Sec. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon 10 days written notice to the landlord. The notice shall also state that upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.

If the Substitute Trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Notice is hereby given that Transylvania County is soliciting bids for the RENOVATION OF THE OLD LIBRARY FOR THE COUNTY ADMINISTRATION BUILDING in Brevard, NC. This project will be bid GENERAL PRIME and consists of the following:

General, HVAC, Plumbing, and Electrical work. The work includes construction of new wood stud partitions, gypsum board finishes, laying acoustical ceiling systems, carpet/sheet vinyl/ceramic floor finishes, hollow metal door frames, flush wood doors, building hardware, casework, HVAC systems, Electrical systems, Plumbing supply/waste piping and various plumbing fixtures, new TPO roof system, etc. In addition, the project will include Site Work consisting of asphalt paving, concrete walks/walkways, stairs, ramps, handrails, masonry retaining walls, landscaping, etc.

DISCHARGE OF UNTREATED SEWAGE

The City of Brevard experienced a discharge of untreated sewage from the sewer pump station located on Neely Road and occurred during a sustained period of heavy rain. Collections System personnel were on call as another band of heavy rain was forecast to move into the Brevard area and surrounding region on Friday, December 6 and overnight into early December 7, 2013. Tennessee Valley Authority reported a total of .98 inches of precipitation was received on Friday, December 6, 2103 and an additional .03 inches on Saturday, December 7, 2013. The discharge event occurred at approximately 11:55 PM on Friday, December 6, 2013 and continued for approximately one hour. Collections System and Maintenance Division personnel remained on duty and monitored pump speed and pressures during this event. Pump and haul personnel were able to capture one load totaling 2,500 gallons of waste for disposal at the Waste Treatment Facility. The total amount resulted in 19,540 gallons discharged from the Neely Road site. The NC Division of Water Quality was notified of the occurrence and applicable required reporting forms were completed for the discharge event.

The City of Brevard remains committed to protecting our natural resources by annually dedicating $100,000 towards an ongoing Inflow / Infiltration Reduction Program to eliminate rain-attributed sanitary sewer overflows (SSO’s) from broken or improperly attached sewer lines, cleanouts, roof drains, and sump pumps through repair and public education, and additionally through capital improvement projects including major sewer line replacements located in the Brushy Creek and Kings Creek basins. As recommended by previous analysis, CDM Smith has performed a flow monitoring study, and data received from this study is currently under review. When complete, this data will provide information for the creation and implementation of a Wastewater Collection System Improvements Plan.

The City of Brevard reminds all customers any discharge of storm water, surface water, groundwater, roof runoff, and subsurface drainage connected to the city sewer system is a violation of the City Code of Ordinances. Customers uncertain of the soundness of their connection to the sewer system may call the City of Brevard Public Services, (828) 884-2171, to confirm if they have a broken cleanout or improperly attached roof drain or sump pump. This notice was required by North Carolina General Statutes Article 21 Chapter 143.215.C.

The ground was already heavily saturated from previous heavy rain the past few days, and after the area received 4.29” of rainfall during the last week of November. Tennessee Valley Authority reported a total of 1.15” of precipitation was received on Monday, December 9, 2013 in addition to the .55” received on Sunday, December 8, 2103. The discharge event occurred at approximately 8:30 AM on Monday, December 9, 2013 and continued for approximately four hours. Collections System and Maintenance Division personnel remained on duty and monitored pump speed and pressures during this event. Pump and haul personnel were able to capture seven loads totaling 17,500 gallons of waste for disposal at the Waste Treatment Facility. The total amount resulted in 81,300 gallons discharged from the Neely Road site. The NC Division of Water Quality was notified of the occurrence and applicable required reporting forms were completed for the discharge event.

A 5’ section of 14” ductile iron force main pipe ruptured on Old Highway 64 near Osborne Road and was replaced by Collections System personnel. The discharge event occurred at approximately 3:30 PM on Monday, December 9, 2013 and ended at 8:45 PM. When alerted the spill response team mobilized and captured 17,500 gallons of sewage from the Neely Road discharge site which was disposed of at the Waste Treatment Facility.

The City of Brevard remains committed to protecting our natural resources by annually dedicating $100,000 towards an ongoing Inflow / Infiltration Reduction Program to eliminate rain-attributed sanitary sewer overflows (SSO’s) from broken or improperly attached sewer lines, cleanouts, roof drains, and sump pumps through repair and public education, and additionally through capital improvement projects including major sewer line replacements located in the Brushy Creek and Kings Creek basins.
