Bids Due: The City will receive bids for the project until 11:00 AM, October 23, 2014 at the Brevard City Hall Conference Room, City Hall, 95 West Main Street, Brevard, NC 28712.

Pre-Bid Conference: A Mandatory pre-bid conference will be held on September 23, 2014 at 11:00 AM at the Brevard City Hall conference room, City Hall, 95 West Main Street, Brevard, NC 28172 for the purpose of answering questions concerning this project. This is a mandatory attendance conference to qualify for submitting a bid. Bidders who do not attend this conference will not be eligible to submit a bid for this project. If a bid is submitted from a bidder who did not attend this conference, the bid will be returned un-opened.

Bidding Documents: The Information for Bidders, Bid Form, Contract, Plans, Specifications, and other contract documents may be examined at the following locations: Brevard Public Services Department, Office of the Public Services Director and the office of Brown Consultants, PA. A complete set of plans, bidding and contract documents must be purchased, non-refundable, for $200 from the engineer.

Bid Security: A 5% bid security is required for this project.

Qualifications: Contactors offering a bid on the project must be licensed to perform Utility work in the State of North Carolina in accordance with North Carolina General Statues and the General Requirements of the NCDENR – DWI Contract Special Condit-ions. The contractor will be required to provide proof of work successfully performed of similar type as this project.

NCDENR – DWI Require-ments: This project is funded with SRF funds. Both bid and post bid submittals are required to meet all MBD/WBE requirements apply to this project.

Award Requirements: The project will be awarded to the responsive, responsible qualified bidder submitting the lowest bid total. Upon award of the project, the successful bidder will be required to provided Payment and Performance Bonds, and proof of general liability and workman’s compensation insurance for this project.

Withdraw of Bid and Informalities: No bidder may withdraw his bid within 90 days after the actual date of the opening thereof. The Owner reserves the right to waive any informalities or to reject any or all bids.

PROPERTY

Site Name: Davidson River Village, LLC

Project Number: 15025-11-88

Pursuant to N.C.G.S. § 130A-310.34, Davidson River Village, LLC, as Prospective Developer, has filed with the North Carolina Department of Environment and Natural Resources (“DENR”) a Notice of Intent to Redevelop a Brownfields Property (“Property”) in Brevard, Transylvania County, North Carolina. The Property, was a part of an assemblage comprising approximately 527 acres (the “Ecusta Mill”), and has been designated the “Tract F Property”, it consists of 119.92 acres and is located at 1 Ecusta Road. Decades of industrial activity at the Ecusta Mill began with the manufacture of cigarette papers in the late 1930s. The Property is southeast of the original plant portion of the Ecusta Mill, is near the confluence of the Davidson River and French Broad River, and was formerly used as a rifle range, and contained the former temporary sludge landfill and leachate pond. Lead impacted soil at the Property was remediated to unrestricted use standards. Davidson River Village, LLC has committed itself to redevelop the property for no uses other than agricultural, residential, hotel, retail and office activities, river use, river recreation, various activities set forth in the proposed Brownfields Agreement and Notice of Brownfields Property referenced below, and any other activities approved in writing by DENR in advance. The Notice of Intent to Redevelop a Brownfields Property includes: (1) a proposed Brownfields Agreement between DENR and Davidson River Village, LLC, which in turn includes (a) a map showing the location of the Property, (b) a description of the contaminants involved and their concentrations in the media of the Property, (c) the above-stated description of the intended future use of the Property, and (d) proposed investigation and remediation; and (2) a proposed Notice of Brownfields Property prepared in accordance with G.S. 130A-310.35.

Written public comments may be submitted to DENR within 30 days after the latest of the following dates: the date this Notice is (1) published in a newspaper of general circulation serving the area in which the Property is located, (2) conspicuously posted at the Property, and (3) mailed or delivered to each owner of property contiguous to the Property. Written requests for a public meeting may be submitted to DENR within 21 days after the period for written public comments begins. Those periods will start no sooner than September 15, 2014, and will end on the later of: a) 30 and 21 days, respectively, after that; or b) 30 and 21 days, respectively, after completion of the latest of the three (3) above-referenced dates.
