NOTICE OF

DISCHARGE OF UNTREATED SEWAGE

The City of Brevard experienced a discharge of untreated sewage from the sewer pump station located on Neely Road and occurred as a result of rain attributed inflow in the Brevard area and a force main pipe rupture on Old Highway 64. This discharge event began at on Wednesday, February 3, 2016 at 5:40 AM and lasted for approximately 15 hours. Collections System and Maintenance Division personnel remained on duty and monitored pump speed and pressures during the event. The total estimated amount of discharge was 343,140 gallons from the Neely Road site. Pump & haul personnel and Mike’s Septic Service captured 96,500 gallons of sewer and this amount was disposed of at the Waste Treatment Facility. The estimated volume reaching surface waters of Lambo Creek Basin was approximately 246,640 gallons.

Similar ruptures along this force main line have occurred due to age and deterioration. A grant funded project from the NCDENR Division of Water Quality State Revolving Fund includes replacement of the 14” force main line by 2017.

Citizens are reminded that any discharge of storm water, surface water, ground water, roof runoff, and subsurface drainage connected to the city sewer system is a violation of the City Code of Ordinances. Customers uncertain of the soundness of their connection to the sewer system may call the City of Brevard Public Works Department at (828) 884-2171 Option 4 to confirm if they have a broken cleanout or improperly attached roof drain or sump pump. This notice was required by North Carolina General Statutes Article 21 Chapter 143.215.C.

CITY OF Brevard, North CAROLINA

The Brevard City Council will hold a public hearing on Monday, February 15, 2016. The hearing will begin at 7:00 PM, or as soon thereafter as possible, in the City Council Chambers of Brevard City Hall, located at 95 West Main Street, Brevard NC 28712.

The City of Brevard plans to submit a North Carolina Small Cities Community Development Block Grant application (hereafter, Downtown Redevelopment Fund) for funds to be used for the prevention or elimination of slums or blight. If funded, the application will provide funds that will support a redevelopment project to meet current code requirements in a vacant or underutilized downtown commercial building for economic development purposes.

This public hearing is prerequisite to making the Downtown Redevelopment Fund application.  The purpose of the Hearing is to obtain citizen input into the identification of needs and desired activities for infrastructure upgrades of downtown buildings in order to meet current code requirements in vacant or underutilized downtown commercial buildings for economic development purposes and the elimination of slums or blight.

The input from this public hearing will be incorporated into the City of Brevard’s consideration and submission of a Downtown Redevelopment Fund application to the North Carolina Department of Commerce. The public is invited to attend this public hearing and make comment. If the trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the trustee. If the validity of the sale is challenged by any party, the trustee, in their sole discretion, if they believe the challenge to have merit, may request the court to declare the sale to be void and return the deposit. An order for possession of the property may be issued pursuant to N.C.G.S. § 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold.

Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may after receiving the notice of foreclosure sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days but not more than 90 days, after the sale date contained in this notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.

Most voters will be asked to present acceptable photo identification when presenting to vote in person at the polls, with exceptions for voters who are unable to obtain acceptable photo identification, have a religious objection to being photographed, or are victims of a natural disaster. The acceptable forms of photo identification are a NC Driver’s License or DMV-issued Identification Card (expired up to four years), US Passport or Passport Card (unexpired), Military ID Card or Veterans Affairs ID Card (unexpired, if there is an expiration date), and certain Tribal Enrollment Cards. VOTERS WHO ARE UNABLE TO OBTAIN ONE OF THESE FORMS OF IDENTIFICATION MAY STILL VOTE IF THEIR INABILITY IS DUE TO A REASONABLE IMPEDIMENT such as a lost or stolen ID, lack of transportation, illness or disability, a lack of proper documents, work schedule, and others. These voters may vote a provisional ballot after completing a Reasonable Impediment Declaration and providing an alternate form of identification or the last four digits of their social security number and their date of birth. Acceptable alternate forms of identification for voters who complete a Reasonable Impediment Declaration include their voter registration card or current utility bill, paycheck, government check, bank statement, or other government document bearing the voter’s name and current address. Alternative voting options are available for voters who do not present acceptable photo identification for a reason other than a reasonable impediment to obtaining one. Voters who use curbside voting may also present one of the alternative forms of identification described above. No identification is required to vote an absentee ballot by mail. Free Identification Cards for registered voters are available from the NC DMV. Absentee Ballots are allowed. Requests for an absentee ballot must be made on the State Absentee Ballot Request Form, available at the Board of Elections office, and received in the Transylvania County Board of Elections office by 5:00 PM on Tuesday, March 8, 2016. Absentee voting begins on Monday, January 25, 2016 and ends at 5:00 PM, Tuesday, March 8, 2016. The Board of Elections will meet February 23 and March 1, 3, 8, 10 and 14 at 5:00 PM, March 12 at 3:00 PM, March 15 at 2:00 PM, and other times as may be necessary for the purpose of approving absentee ballot applications.

One-stop absentee voting will be held in the Rogow Room of the Transylvania County Library, 212 S. Gaston St., Brevard, and the Rosman Town Hall, 6 Main St., Rosman, beginning Thursday, March 3, 2016 and ending Saturday, March 12, 2016. One-stop voting hours are weekdays, 10:00 AM to 6:00 PM and Saturdays, 10:00 AM to 1:00 PM.

The Canvass meeting will be held at 11:00 AM in the Transylvania County Board of Elections Office, 221 S. Gaston St., Brevard, on Tuesday, March 22, 2016.

All residents of Transylvania County who have resided in the county for at least 30 days prior to Election Day and are registered to vote with the Transylvania County Board of Elections may vote in this election. Voters who are previously registered need not re-register for this election. Those voters who are registered unaffiliated may vote in the primary election. Unaffiliated voters will be given a choice of ballot at the polling places. Those residents who are not registered must register on or before Friday, February 19, 2016 in order to be eligible to vote in this election. Those voters who are not registered by Friday, February 19, 2016 may register and vote during one stop early voting only, and will be required to provide documentation of their identity and residence. Voters who wish to change their party affiliation or who have changed their name or address must notify the Board of Elections in writing by Friday, February 19, 2016. Voters who fail to notify the Board of Elections of a change in their name or address must update their information when presenting to vote, and may be required to vote a provisional ballot.

Voters who require assistance with casting their ballot are entitled to assistance by an appropriate person of their choice or an election official. Registration facilities and polling places are accessible to elderly and handicapped. Curbside voting is available for voters who are not physically able to enter the polling place.

The City of Brevard experienced a discharge of untreated sewage from the sewer pump station located on Gallimore Road on Wednesday, February 3, 2016 and occurred as a result of rain attributed inflow and a force main pipe rupture on Old Highway 64. The lift station discharge began at approximately February 3, 2016 at 7:44 AM and continued for 8.17 hours. The estimated volume reaching surface waters of Brushy Creek Basin was approximately 135,436 gallons.

Similar ruptures along this force main line have occurred due to age and deterioration. Funding is included for the Neely Road Pump Station Upgrade Project, Neely Road Force Main Replacement, and Flow Equalization Tank in a recently awarded grant funded project from the NCDENR Division of Water Quality State Revolving Fund; and 13,000’ of this 14” force main line will be replaced by 2017.

The City of Brevard remains committed to preserving and protecting our natural resources with capital projects and investment in infrastructure rehabilitation. This notice was required by North Carolina General Statutes Article 21 Chapter 143.215.C.

Under and by virtue of a Judgment of the Presiding District Court Judge for Transylvania County, North Carolina, made and entered in the action entitled “County of Transylvania vs. Suzanne Morgan, et al.” the undersigned Commissioner will, on the 22nd day of FEBRUARY, 2016, at 11:30 a.m., offer for sale and sell for cash, to the last and highest bidder at public auction, the real property described in the attached Exhibit “A” incorporated herein by reference. The property lies within Transylvania County, North Carolina, and is more particularly described in Exhibit “A” PIN: 8594-03-4534-000 (Paul Owen Road), attached hereto. The sale will be held on the Transylvania County Courthouse steps, 7 E. Main Street, Brevard, North Carolina.

The sale will be made subject to all outstanding City and County taxes and all superior restrictions of record and local improvement assessments against the above-described property not included in the Judgment in the above-entitled cause. All junior liens will be extinguished upon sale.

The property, together with all buildings, fixtures and improvements thereon, is being sold “as is, where is” without warranty.

The terms of sale are that the real property described in Exhibit “A” will be sold for cash to the highest bidder and that the undersigned will require the successful bidder at the sale to immediately deposit cash or a certified check in the amount of five (5%) percent of the last bid or $750.00, whichever is greater. Any successful bidder shall be required to tender the full balance purchase price so bid in cash or certified check at the time the Commissioner tenders the bidder a Deed for the property, or attempts tender of such Deed. Should the successful bidder fail to pay the full balance of the purchase price bid, the bidder shall remain liable for said bid. The Transylvania County Tax Collector may make a credit bid.

This sale will remain open for ten (10) days, as by law required, at which time an upset bid may be made with the Clerk of Court for Transylvania County, North Carolina. The Notice may be withdrawn at any time until the conclusion of the sale.

BEGINNING at an iron pin located south of a private road, said iron pin being the southeast corner of that certain tract of land conveyed by Harold Walter Hogsed to Lula Hogsed Morgan by deed dated August 21, 1961, and recorded in Book 136, page 152, Records of Deeds for Transylvania County, North Carolina, and runs thence from said beginning point with the line of the McGee property, North 75 deg. West 104.96 feet to an iron pin; thence a new line, North 12 deg. 06 min. East 127.8 feet to an iron pin; thence another new line, South 82 deg. 37 min. East 213.31 feet to an iron pin located east of the private road hereinabove mentioned, said iron pin being located in the line of the Roy Gravely property; thence with the line of the Roy Gravely property, the following three calls: South 28 deg. 30 min. West 20 feet to a stake; South 62 deg. West 93 feet to a stake and South 35 deg. 30 min. West 78 feet to the BEGINNING, containing .50 acres more or less, as surveyed and platted by P.R. Raxter, RLS, on March 16, 1971.

Together with a right-of-way for a road leading from State Road 1538 to the property herein described, said right-of-way to be along the said road as the same is now laid out and located.

Being all of the same land described in a deed from Lula Hogsed Morgan, and husband, George Johnson, to Roger Newton and wife, Sharon M. Newton, dated April 9, 1971, and recorded in Book 188, Page 728, Records of Deeds for Transylvania County, North Carolina.

Take notice that a pleading seeking relief against you has been filed in the above-entitled juvenile action. The nature of the relief being sought is the termination of your parental rights in and to Minor Boy T.P.C., born on or about 5 August 2001 in Transylvania County, North Carolina. A court order from the District Court of Henderson County directing that service of process on you take place by publication was entered on the 4th day of February 2016.

You must answer or otherwise respond to the pleading within thirty (30) days of the date of first publication of this Notice stated below (forty (40) days if you are listed as an “unknown parent”). If you fail to answer or otherwise respond within the time prescribed, your parental rights in and to the juvenile referred to above will be terminated.

If you are indigent and not already represented by appointed counsel, you are entitled to appointed counsel in this matter, and to that end, provisional counsel has been appointed for you in this matter, and that the appointment of provisional counsel shall be reviewed (including the issue of whether to release such provisional counsel if you do not appear) by the court at the first hearing after service of process in this matter.
