Superior Court Term Starts Today

Superior Court returns to Transylvania County today, with the trial of a male school student accused of ethnic intimidation and the felony embezzlement charge facing Annette Raines, the former county tax administrator, among the cases on the docket.

In November, the student, who was 17 at the time of the incident last May, was found guilty in Criminal District Court of one misdemeanor count of ethnic intimidation and one misdemeanor count of simple assault against.

The student was found guilty of threatening to hang a fellow 17-year-old Brevard High School student at the time with a noose and swung a pocket knife at him.

Judge Athena Brooks found the accused student guilty of the two charges in District Court and sentenced him to a 45-day suspended sentence, with 12 months of unsupervised probation.

His attorney, Donald Barton, appealed the case to Superior Court. The case is the first scheduled on the trial list.

The Transylvania Times typically doesn’t report the names of juveniles involved in the legal system.

In February of last year, a grand jury indicted Raines for felony embezzlement. She is accused of embezzling tens of thousands of dollars from the Transylvania County Rescue Squad’s bank accounts.

According to the squad’s management, it discovered in April of 2016 that Raines was taking unauthorized ATM withdrawals from the squad’s bank account for her own use.

In June of 2016, Assistant Special Agent Tom Ammons, with the SBI’s Western District Office, said Raines was the person of interest in an active investigation involving the embezzlement of funds.

Raines had been the squad’s treasurer since before 2009. She was named county tax administrator in September of 2014. She resigned from the position shortly before she was named by the SBI as the person of interest in the case.

Raines’ case is not listed on the trial list but on the regular court docket.

Judge Marvin P. Pope Jr. is scheduled to preside during the term.
