It’s a misdemeanor. Under federal statute, illegally entering the United States is a misdemeanor punishable by a fine up to $5,000 and/or a maximum of six months in prison. Yet, parents who are charged with this misdemeanor are being physically separated from their children. The children are taken away to live in tent cities or buildings where they are housed in cages under the auspices of the Department of Health and Human Services (DHHS).
