NOTICE OF MUNICIPAL ELECTION FOR THE City of Brevard, North CAROLINA

Notice is hereby given pursuant to GS 163-33(8) that a Municipal Election will be held on Tuesday, November 5, 2019 in the City of Brevard, North Carolina for Members of City Council. Polls will be open from 6:30 AM to 7:30 PM. The polling places for each precinct will be located at:


Brevard #1: Election Center Conference Room, 150 S. Gaston St., Brevard;

Brevard #2: VFW Building, 50 Veterans Cir., off Nicholson Creek Rd., Brevard;

Brevard #3: Transylvania County Rescue Squad-Brevard Unit, 233 Fisher Rd., Brevard;


Brevard #4 – Brevard College Porter Center Scott Commons Hall, Brevard College Dr., Brevard;

Pisgah ForestTransylvania County Public Safety Facility, 153 Public Safety Way, Brevard.

Absentee ballots are allowed. Requests for an absentee ballot must be made in writing and received in the Transylvania County Board of Elections office by 5:00 PM on Tuesday, October 29, 2019. Absentee voting begins on Monday, October 7, 2019 and turned in by 5:00 PM, Monday, November 4, 2019. The Board of Elections will meet October 15, 22, 29, and November 4 at 5:00 PM, November 5 at 2:00 PM, and other times as may be necessary for the purpose of approving absentee ballot applications.


One-stop early voting will be held in the Election Center, 150 S. Gaston St., Brevard, beginning Wednesday, October 16, 2019 and ending Friday, November 1, 2019. One-stop voting hours are Monday through Friday, 8:30 AM to 5:00 PM and Saturday, October 26, 2019 from 8:30 AM until 1:00 PM.


The Canvass meeting will be held at 11:00 AM in the Election Center, 150 S. Gaston St., Brevard, on Friday, November 15, 2019.

All residents of the City of Brevard who have resided within the corporate limits of the City of Brevard for at least 30 days prior to Election Day and are registered to vote with the Transylvania County Board of Elections may vote in this election. Voters who are previously registered need not re-register for this election. Those residents of the City of Brevard who are not registered must register on or before Friday, October 11, 2019 in order to be eligible to vote on Election Day. Any voter who has moved outside his or her precinct but within the county or changed their name since the last election should notify the Board of Elections in writing by Friday, October 11, 2019.

NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE

In the event the property which is the subject of this Notice of Sale is residential real property with less than fifteen (15) rental units, an order for possession of the property may be issued pursuant to N.C.G.S. § 45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. The notice shall also state that upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.

Should the property be purchased by a third party, that person must pay the tax of forty-five cents per One Hundred Dollars ($100.00) required by NCGS 7A-308 (a)(1), up to a maximum of Five Hundred Dollars ($500.00). The property is being sold “as is and where is” with no representations or warranties of any type or kind being given or to be construed as being given or made; and, no title certification of any type or kind is being made or is to be construed as being made. The terms of the sale are that the real property hereinabove described will be sold for cash to the highest bidder and that the undersigned will require the successful bidder at the sale to immediately deposit cash or certified check in the amount of the greater of five percent (5%) of the amount of the bid or seven hundred and fifty dollars ($750.00), whichever is greater. The real property hereinabove described will be sold subject to any unpaid taxes, prior encumbrances, if any, and special assessments.

The sale will be held open for ten (10) days for upset bids as by law required and will also be subject to a ten (10) day right of redemption or to the filing of a bankruptcy petition. In the event of an upset bid, redemption or the filing of a bankruptcy petition, or any other reason that the Substitute Trustee deems necessary to redo the sale, the bid deposit will be returned and no other remedies will be assertable.
