4. The terms of the sale shall be that the real property hereinabove described will be sold for cash to the highest bidder and that the Commissioner shall require the successful bidder at sale to immediately deposit cash, certified check or bank check in the amount of 5% of the amount of bid which shall be provided to the Commissioner within 2 hours of the conclusion of the sale. The real property hereinabove described shall be sold subject to all prior liens, deeds of trust, unpaid taxes, restrictions and easements of record, tax liens and assessments. Said property shall be offered pursuant to the Notice of Sale as being offered for sale, transfer and conveyance “as is, where is”. There will be no representations of warranty relating to the title or any physical, environmental health or safety conditions existing in, on, at or relating to the property being offered for sale.

5. The sale will be held open for 10 days for upset bids as by law required.

6. Upon the final sale of the Real Property, after the filing of report(s) of sale and the passage of time for upset bids as provided by law, the Commissioner shall pay all costs for the proceeding as provided by law and approved by the Clerk of Superior Court, at which time the Commissioner shall distribute the remaining sales proceeds one-half to the Petitioner and one-sixth to each of Sharon Z. Vincent, Cynthia Z. Chenery, and Sheila Z. Pravlik.

Proposed Moratorium on Electronic Display Signs

The Brevard City Council will hold a public hearing on Monday, November 18, 2019. The hearing will begin at 7:00 p.m. or as soon thereafter as possible in the Council Chambers of the Municipal Building located at 95 West Main Street to consider the following:

Pursuant to North Carolina General Statute 160A-381, notice is hereby given that the Brevard City Council will conduct a public hearing on Monday, November 18, 2019 for the purpose of receiving information on whether or not to implement a Moratorium prohibiting the City of Brevard from approving electronic display signs, including flashing or moving signs, and signs with moving or changing text, for a period of not more than six months, to allow time for the Brevard Planning Board to make a study and recommend any changes to the existing Unified Development Ordinance regarding such signs, including but not limited to changes to the existing Section 12.9.D of the Uniform Development Ordinance, entitled, “Electronic Display Signs.

Transylvania County Election Center

RESOLUTION

Concerning the Counting of Absentee Ballots

WHEREAS, North Carolina General Statute 163-234 authorizes a county board of elections to establish a place and a time between the hours of 2:00 p.m. and 5:00 p.m. on election day for the counting of absentee ballots; and,

WHEREAS, NCGS 163-234 also authorizes a county board of elections to meet in the board office on election day for the purpose of counting absentee ballots; now,

THEREFORE, BE IT RESOLVED by the Transylvania County Board of Elections that

1) The Transylvania County Board of Elections shall meet at 2:00 p.m. on Tuesday, November 5, 2019 in the office of the Board, 150 South Gaston Street, Brevard, North Carolina, to count absentee ballots.

2) Any voter of the county may attend this meeting and observe the count.

3) The results of the absentee ballot count will not be announced before the close of polls on that day.

BE IT FURTHER RESOLVED that this resolution be published in The Transylvania Times once each week for two weeks prior to the general election to be held on November 5, 2019.
